When tenancy agreements end in dispute Mary Hoban collaborates with Hocking Stuart Albert Park property manager Elle Gyorffy to create fraudulent cost claims for building repairs they allege are caused by tenants in order to opportunistically keep bonds. In reality the structural dampness and the decaying unrepaired condition of the premises are the cause of peeling paint, mould growth and discolouring in the worn out stained carpet.

The tenant paid $74,898 to Hocking Stuart Albert Park for an 18-month tenancy at the 70 Kerferd Road Albert Park VIC 3206 rental property and during that time Mary Hoban did nothing to address the problems.

At a routine inspection Mary Hoban asked the tenant if an inoperative bathroom fan should be repaired? The tenant replied to Mary Hoban and the Hocking Stuart property manager with words to the effect, “it’s your call.” The fan was never repaired.

“Hocking Stuart & the landlord inspected the rented premises on Saturday 23/11/19 & the inspection revealed the following:

The fan in the en-suite bathroom is not functioning properly. This was not reported to the landlord and as a result mould has developed on the ceiling in the en-suite bathroom. This will need to be dealt with by an electrician and a painter.”

Contrary to true events and the real issues causing the property to decay, Mary Hoban and Hocking Stuart Albert Park property manager Elle Gyorffy work together to create fraudulent cost claims aimed at funding well overdue maintenance and repairs to the property.

Rats, mice & fruit flies are at plague level

  • Rats nest permanently in the reverse cycle heating & cooling system main control box;
  • Rats have taken over the external laundry making it uninhabitable for human use;
  • Rats run 24/7 throughout the rear yard, along the adjoining boarding house fence, over the external laundry roof, over the top of the diseased lime tree, over the rear pergola and in the kitchen cupboards;
  • Mice over-run the entire upstairs/downstairs residence and are seen running around 24/7;
  • Rats were discovered nesting in a new gas Weber BBQ used for month’s to regularly cook organic protein and seafood – the tenant immediately discarded the BBQ as rubbish after disturbing the rats when lighting the BBQ; &
  • Fruit flies breed in a diseased lime tree causing an infestation throughout the residence.

Lounge & dining room have a permanent foul stench of mice & rats

  • The lounge & adjoining dining room carry a strong and very unpleasant smell of rodents;
  • The permanent foul smell becomes worst in warm weather; &
  • Whenever you attempt to watch television or sit in the dining room you notice mice darting to and from the fire-place from large gaps between the flooring & skirting boards.

Decay, disrepair, structural dampness, rot, bacteria & fungi is affecting the residence inside & out

  • Unstable creaking floors upstairs and downstairs cause excessive noise and wake sleeping residents when used by others;
  • Brick pavers have been laid unprofessionally on uneven soil with excessive soil between bricks causing uncontrollable weed growth;
  • Electrical switchboard and wiring is decaying, faulty and causes fuse box to consistently switch off during use of appliances;
  • Carpet is extensively stained, rotting, impractical to clean and beyond repair or being reinstated;
  • Kitchen cupboard door handles are ergonomically defective and cannot be used for normal daily use;
  • Skirting boards are warped and huge gaps provide free access for rats and mice to enter and exit residence;
  • Upstairs toilets are so old that uncontrollable bacteria & fungi growth makes cleaning and hygiene impossible;
  • Broken and missing glass in front door has never been replaced and causes excessive draft affects to the residence;
  • Door frames are termite infested causing downstairs doors to not close and to come off hinges; &
  • Glass door panels in dining room (facing boarding house) have permanent ½ inch gaps around all edges that in winter cause constant draft-force winds to circulate through lounge and dining room area making it necessary to wear a coat or jacket or doona if sitting on sofa as heating system doesn’t function properly.

No fly screens cause insect infestation to the internal residence

  • Since there are no fly screens on any downstairs doors or windows, fruit flies, blowflies and bugs over-run the residence.

No blinds in kitchen means there is nil privacy from adjoining boarding house windows

  • Since there are no blinds for privacy (no visual screening) in the kitchen, the adjoining boarding house windows look directly into the kitchen 24/7; &
  • There is also no acoustic screening and consequently you can over-hear conversations in the boarding house rooms and vice versa.

Malfunctioning reverse cycle heating & cooling system is in disrepair

  • The system malfunctions causing upstairs vents to be completely inoperative;
  • The cooling capability is completely inoperative; &
  • The heating capability only operates from 2 downstairs vents in the kitchen and provides no effect in the lounge or dining room.
